  2. No Doctor-Patient Relationship: Your use of this website, communication with our team, or purchase of any ElitePosture product does not create a chiropractor-patient or doctor-patient relationship between you and Dr. John Bassily, DC.

Consult Your Healthcare Provider: If you suffer from chronic, severe, or worsening neck pain, back pain, or have a diagnosed spinal condition (including but not limited to herniated or bulging discs, spinal stenosis, severe arthritis, or recent cervical surgery), you are strictly advised to consult your personal primary healthcare provider or chiropractor before using our products.

SECTION 2 — LIMITATION OF LIABILITY

By purchasing and using the ElitePosture cervical pillow, you acknowledge and agree that you do so entirely at your own risk.

In no case shall ElitePosture, our directors, officers, employees, affiliates, agents, contractors, interns, or suppliers—including Dr. John Bassily, DC—be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, any physical discomfort, muscle soreness, perceived lack of clinical results, or injury resulting from the use or misuse of our products.

Because standard cervical alignment may feel firm or cause mild initial adjustment stiffness (as detailed in our Return Policy), you agree that temporary physical adaptation to a corrective postural product is normal and does not constitute grounds for legal liability or medical malpractice claims against ElitePosture or Dr. John Bassily, DC.

SECTION 3 — ONLINE STORE TERMS & ACCURACY

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence.

 

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction. A breach or violation of any of the Terms will result in an immediate termination of your Services and potentially appropriate legal action.

SECTION 5 — PRODUCTS OR SERVICES

Our ergonomic pillows are available exclusively online through the website. These products have limited quantities and are subject to return or refund only according to our 30-Night Sleep Trial & Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's or phone screen's display of any color will be completely accurate.

SECTION 6 — BILLING AND ACCOUNT ACCURACY

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
